Holding Tank Permits

Where the department determines that no health hazard will result, holding tanks shall be permitted meeting setbacks that are 50% of the setback requirements of Rule 64E-6.005(1) through (3), provided that they are placed within secondary containment structures with a containment capacity of no less than 110% of the total waste capacity of the holding tank.

Portable holding tanks may not exceed a total effective capacity of 300 gallons. No portion of the portable holding tank may be more than 12 inches below the ground surface. The portable holding tank must be rigid, water-tight and impervious. Multiple portable holding tanks, if used, shall be connected in such a manner that leakage from one tank will not result in the loss of any liquid from any other tank.

 

Inspections are required to be made of holding tank installations to approve placement and to inspect tank integrity.

 

Holding tanks at construction sites are not bound by the definition of temporary. They may stay in use for the duration of construction as outlined in Rule 64E-6.0101(7)(a). All other holding tanks are "temporary" systems to be used no more than 120 days in a 365 day period.

 

An applicant for a holding tank installation permit shall provide to the health department a copy of a contract with a permitted disposal company stating the holding tank capacity, a site plan including the proposed location of the holding tank in proximity to all surrounding features (potable waterlines, surface water, building, driveway), and the scheduled pumping frequency, along with a completed application form (DH 4015)

 

The permit fee for a holding tank is $385.00 and includes review, permit, and inspection.

 

Size determinations for holding tanks are as follows:

Holding tanks shall be pumped at least weekly to prevent unsanitary conditions.
