If you wish to apply for a septic system construction permit in Charlotte County but cannot meet the requirements in Chapter 62-6, Florida Administrative Code, you can request a variance.
The Florida Department of Environmental Protection (DEP) is authorized to grant septic variances when:
- The hardship was not caused intentionally by the action of the applicant
- There is no reasonable alternative, taking into consideration factors such as cost
- The discharge from the onsite sewage treatment and disposal system will not adversely affect the health of the applicant or the public or significantly degrade the groundwater or surface waters
How to Apply
Applicants must complete and submit part one of the Application for Variance from Chapter 62-6, FAC (DEP 4057) and pay a fee to DOH-Charlotte to process their request.
Once you’ve submitted your application, DOH-Charlotte’s Environmental Public Health staff will review your submission, complete part two of the application, and submit it to DEP on your behalf. It can take up to a week for us to process your application. Once DEP receives the completed application, they will review it at their next variance committee meeting.
